Política de privacidad y de tratamiento de datos personales

1. Responsable. La presente política describe el tratamiento de información asociado al juego web «History's Gambit — Chess Campaigns of Legend» (en adelante, el «Servicio»), cuyo responsable es la titularidad del proyecto History's Gambit (en adelante, el «Responsable»), con base de operaciones en la República de Colombia y canal de contacto para todos los asuntos relativos a esta política en la dirección de correo electrónico historysgambit@gmail.com. Esta política se redacta en atención a lo dispuesto en la Ley Estatutaria 1581 de 2012 y sus decretos reglamentarios, en lo que resulte aplicable, así como, respecto de usuarios residentes en el Espacio Económico Europeo, en el Reglamento (UE) 2016/679 («RGPD»).
2. Juego sin cuenta: almacenamiento exclusivamente local. Una parte del Servicio —en particular la primera crónica, el reto diario, el tutorial de iniciación y un primer intento del modo «La Encrucijada»— puede utilizarse de forma gratuita, sin crear cuenta ni facilitar dato personal alguno. En esta modalidad, el Servicio se ejecuta íntegramente en el navegador del usuario y no utiliza cookies (ni propias ni de terceros) ni herramientas de perfilado, seguimiento entre sitios o publicidad; la única medición es la analítica de audiencia agregada y sin cookies descrita en la cláusula 5, que no identifica al usuario ni almacena información en su dispositivo. El progreso de juego (misiones completadas, estrellas, rachas y logros) y las preferencias (idioma y sonido) se almacenan exclusivamente en el mecanismo de almacenamiento local («localStorage») del navegador, en el propio dispositivo del usuario, no se transmiten al Responsable ni a terceros, y pueden eliminarse en cualquier momento limpiando los datos de navegación del sitio. La finalidad exclusiva de dicho almacenamiento es el funcionamiento del juego solicitado por el usuario, sin elaboración de perfiles ni cruce de información de clase alguna.
3. Cuenta para acceder al resto del contenido y sincronizar el progreso. Para acceder a las campañas distintas de la primera crónica, y para continuar en el modo «La Encrucijada» tras una derrota, el usuario debe crear una cuenta, que además conserva su progreso y lo sincroniza entre dispositivos. A tal efecto se tratan los siguientes datos: (i) la dirección de correo electrónico facilitada y (ii) una contraseña, que no es conocida ni almacenada en claro por el Responsable, sino gestionada y almacenada de forma cifrada (hash) por el proveedor de identidad; y (iii) los datos de progreso de juego antes descritos. La finalidad del tratamiento es la autenticación del usuario, el control de acceso a las funcionalidades que requieren registro y la conservación y sincronización de su progreso; la base jurídica es la ejecución de esta funcionalidad solicitada por el propio usuario y, en su caso, su consentimiento, revocable en cualquier momento mediante la supresión de la cuenta. Estos datos se tratan por cuenta del Responsable a través de Supabase (Supabase, Inc.), en calidad de encargado del tratamiento, en cuya infraestructura se alojan; se conservan mientras la cuenta permanezca activa y se suprimen al eliminarse esta. La verificación de la dirección de correo se realiza mediante el envío de un mensaje de confirmación. El usuario puede solicitar el acceso, la rectificación o la supresión de su cuenta y de los datos asociados escribiendo a historysgambit@gmail.com. El registro es necesario para el contenido adicional indicado; quien no desee tratamiento alguno de datos puede, en todo caso, seguir utilizando de forma gratuita la parte del Servicio descrita en la cláusula anterior (primera crónica, reto diario y tutorial) en modalidad exclusivamente local.
4. Tratamientos efectuados por terceros con ocasión del acceso. Sin perjuicio de lo anterior, el usuario debe conocer que el acceso al Servicio comporta, por su propia naturaleza técnica, determinados tratamientos efectuados por terceros proveedores de infraestructura sobre los que el Responsable no ejerce control: (i) el alojamiento y la red de distribución de contenidos del Servicio se prestan mediante Cloudflare Pages, de Cloudflare, Inc., que puede registrar en sus servidores datos técnicos de conexión, incluida la dirección IP del usuario, con fines de entrega del contenido y de seguridad (protección frente a ataques), conforme a su política de privacidad; y (ii) la funcionalidad opcional de narración por voz se apoya en la interfaz Web Speech del propio navegador del usuario, cuyo procesamiento puede efectuarse localmente o en servidores del proveedor del navegador según la configuración y políticas de este; y (iii) si el usuario realiza la compra opcional de contenido premium, el pago lo procesa Lemon Squeezy (Lemon Squeezy, Inc.) en calidad de Merchant of Record (vendedor), que trata los datos de pago necesarios conforme a su propia política de privacidad —el Responsable no recibe ni almacena los datos de la tarjeta—, y la activación de la clave de licencia adquirida implica enviar dicha clave a los servidores de Lemon Squeezy para su validación. Las tipografías del Servicio se sirven desde el propio sitio (auto-alojadas), por lo que su carga no genera petición alguna a servidores de terceros. Se recomienda al usuario la consulta de las políticas de privacidad de los terceros mencionados.
5. Analítica de audiencia agregada y sin cookies. Con la finalidad de conocer el uso general del Servicio y mejorarlo, este emplea Cloudflare Web Analytics, de Cloudflare, Inc. —el mismo proveedor que presta el alojamiento y la red de distribución del Servicio—. Esta herramienta no utiliza cookies ni accede a información almacenada en el dispositivo del usuario, no recopila datos personales identificables, no realiza seguimiento entre sitios ni elaboración de perfiles, y no permite reidentificar a personas concretas. La medición se obtiene de forma agregada a partir de datos técnicos de la propia petición (como la página visitada, el referente, el país aproximado y el tipo de dispositivo); la dirección IP es procesada de forma transitoria por Cloudflare al solo efecto de generar estas métricas agregadas, no se conserva asociada a ellas ni se pone a disposición del Responsable de manera individualizada. La base jurídica es el interés legítimo del Responsable en medir y mejorar el funcionamiento del Servicio (art. 6.1.f RGPD); al no emplearse cookies ni almacenamiento en el dispositivo, su uso no precisa el consentimiento previo exigible a otras tecnologías de seguimiento. Este tratamiento se rige adicionalmente por la política de privacidad de Cloudflare. El usuario puede impedir esta medición mediante extensiones de bloqueo en su navegador.
6. Derechos del titular de los datos. El usuario tiene reconocidos los derechos de conocimiento, acceso, actualización, rectificación, supresión y revocatoria de la autorización, conforme a la Ley 1581 de 2012, y los derechos de acceso, rectificación, supresión, oposición, limitación del tratamiento y portabilidad, conforme a los artículos 15 a 22 del RGPD. Respecto de la información almacenada localmente en el dispositivo (juego sin cuenta), su ejercicio se satisface mediante la limpieza por el propio usuario de los datos de navegación del sitio. Respecto de los datos asociados a una cuenta (correo, contraseña y progreso sincronizado), el usuario puede ejercer dichos derechos —incluida la supresión de la cuenta y de todos sus datos— dirigiéndose al Responsable en historysgambit@gmail.com, solicitud que será atendida en los plazos legales. Frente a los tratamientos de los terceros proveedores mencionados, el usuario podrá acudir además a los canales que estos disponen. El usuario tiene asimismo derecho a presentar reclamación ante la Superintendencia de Industria y Comercio de Colombia o, en su caso, ante la autoridad de control competente de su lugar de residencia en el Espacio Económico Europeo.
7. Menores de edad. El Servicio es apto para todos los públicos y no se dirige específicamente a menores de edad. No se solicita ni recaba conscientemente información de menores; en particular, la creación de cuenta presupone la capacidad legal para aceptar los términos del Servicio.
8. Seguridad, conservación y ubicación. Los datos asociados a una cuenta se tratan a través del proveedor Supabase, que aplica medidas técnicas y organizativas de seguridad sobre su infraestructura, incluida la transmisión cifrada (HTTPS) y el almacenamiento de la contraseña mediante funciones de hash, de modo que el Responsable no tiene acceso a la contraseña en claro. Dichos datos se conservan mientras la cuenta permanezca activa y se eliminan al suprimirse esta a solicitud del usuario. La información almacenada localmente en el dispositivo permanece bajo el exclusivo control del usuario y subsiste hasta que este la elimine. Los datos de cuenta pueden alojarse en servidores del proveedor situados fuera del país de residencia del usuario; al crear la cuenta el usuario acepta dicha transferencia internacional en los términos aquí descritos.
9. Modificaciones de la presente política. El Responsable podrá actualizar esta política, publicando la versión vigente, con su fecha de actualización, en esta misma dirección. Cualquier nuevo tratamiento de datos personales (por ejemplo, la incorporación de analítica) se reflejará en la política con carácter previo a su activación, con indicación de su finalidad, base jurídica, plazos de conservación y mecanismos de ejercicio de derechos.

1. Controller. This policy describes the processing of information associated with the web game «History's Gambit — Chess Campaigns of Legend» (the «Service»), whose controller is the ownership of the History's Gambit project (the «Controller»), based in the Republic of Colombia, with a contact channel for all matters relating to this policy at the email address historysgambit@gmail.com. This policy is drafted in accordance with Colombian Statutory Law 1581 of 2012 and its implementing decrees, as applicable, and, with respect to users resident in the European Economic Area, with Regulation (EU) 2016/679 («GDPR»).
2. Use without an account: exclusively local storage. Part of the Service —in particular the first chronicle, the daily challenge, the introductory tutorial and a first attempt at the «The Crossroads» mode— may be used free of charge, without creating an account or providing any personal data. In this mode, the Service runs entirely in the user's browser and uses no cookies (neither first-party nor third-party) nor profiling, cross-site tracking or advertising tools; the only measurement is the aggregated, cookieless audience analytics described in clause 5, which does not identify the user or store information on their device. Game progress (completed missions, stars, streaks and achievements) and preferences (language and sound) are stored exclusively in the browser's local storage («localStorage»), on the user's own device, are not transmitted to the Controller or to third parties, and may be deleted at any time by clearing the site's browsing data. The sole purpose of such storage is the operation of the game requested by the user, without any profiling or cross-referencing of information of any kind.
3. Account to access the rest of the content and synchronise progress. To access campaigns other than the first chronicle, and to continue in «The Crossroads» mode after a defeat, the user must create an account, which also preserves their progress and synchronises it across devices. For this purpose the following data are processed: (i) the email address provided and (ii) a password, which is neither known nor stored in clear text by the Controller, but managed and stored in encrypted form (hash) by the identity provider; and (iii) the game progress data described above. The purpose of the processing is the authentication of the user, access control to the features that require registration, and the preservation and synchronisation of their progress; the legal basis is the performance of this functionality requested by the user and, where applicable, their consent, revocable at any time by deleting the account. These data are processed on behalf of the Controller through Supabase (Supabase, Inc.), as data processor, on whose infrastructure they are hosted; they are kept while the account remains active and are deleted when it is removed. Email verification is carried out by sending a confirmation message. The user may request access to, rectification of, or deletion of their account and associated data by writing to historysgambit@gmail.com. Registration is required for the additional content indicated; anyone who does not wish any data processing may, in any case, continue to use free of charge the part of the Service described in the previous clause (first chronicle, daily challenge and tutorial) in exclusively local mode.
4. Processing carried out by third parties on the occasion of access. Notwithstanding the above, the user should be aware that access to the Service involves, by its very technical nature, certain processing carried out by third-party infrastructure providers over which the Controller exercises no control: (i) the hosting and content delivery network of the Service are provided by Cloudflare Pages, of Cloudflare, Inc., which may log on its servers technical connection data, including the user's IP address, for content delivery and security purposes (protection against attacks), in accordance with its privacy policy; and (ii) the optional voice narration feature relies on the user's own browser's Web Speech interface, whose processing may take place locally or on the browser provider's servers depending on its configuration and policies; and (iii) if the user makes the optional purchase of premium content, the payment is processed by Lemon Squeezy (Lemon Squeezy, Inc.) as Merchant of Record (seller), which processes the necessary payment data in accordance with its own privacy policy —the Controller does not receive or store card data—, and activating the purchased licence key involves sending that key to Lemon Squeezy's servers for validation. The Service's typefaces are served from the site itself (self-hosted), so loading them generates no request to third-party servers. Users are advised to consult the privacy policies of the third parties mentioned.
5. Aggregated, cookieless audience analytics. In order to understand the general use of the Service and improve it, it uses Cloudflare Web Analytics, of Cloudflare, Inc. —the same provider that supplies the hosting and content delivery network of the Service. This tool does not use cookies or access information stored on the user's device, does not collect identifiable personal data, does not carry out cross-site tracking or profiling, and does not allow re-identification of specific individuals. Measurement is obtained in aggregate form from technical data of the request itself (such as the page visited, the referrer, the approximate country and the device type); the IP address is processed transiently by Cloudflare solely to generate these aggregated metrics, is not retained in association with them, and is not made available to the Controller on an individualised basis. The legal basis is the Controller's legitimate interest in measuring and improving the operation of the Service (Art. 6.1.f GDPR); as no cookies or device storage are used, its use does not require the prior consent required for other tracking technologies. This processing is additionally governed by Cloudflare's privacy policy. The user may prevent this measurement by using blocking extensions in their browser.
6. Rights of the data subject. The user is granted the rights of knowledge, access, updating, rectification, deletion and revocation of authorisation, in accordance with Law 1581 of 2012, and the rights of access, rectification, erasure, objection, restriction of processing and portability, in accordance with Articles 15 to 22 of the GDPR. With respect to information stored locally on the device (use without an account), these rights are satisfied by the user clearing the site's browsing data. With respect to data associated with an account (email, password and synchronised progress), the user may exercise these rights —including deletion of the account and all its data— by contacting the Controller at historysgambit@gmail.com, a request that will be addressed within the legal time limits. With regard to the processing by the third-party providers mentioned, the user may additionally use the channels they make available. The user also has the right to lodge a complaint with the Superintendence of Industry and Commerce of Colombia or, where applicable, with the competent supervisory authority of their place of residence in the European Economic Area.
7. Minors. The Service is suitable for all audiences and is not specifically directed at minors. No information from minors is knowingly requested or collected; in particular, creating an account presupposes the legal capacity to accept the terms of the Service.
8. Security, retention and location. Data associated with an account are processed through the provider Supabase, which applies technical and organisational security measures on its infrastructure, including encrypted transmission (HTTPS) and storage of the password using hash functions, so that the Controller has no access to the password in clear text. Such data are kept while the account remains active and are deleted when it is removed at the user's request. Information stored locally on the device remains under the exclusive control of the user and persists until they delete it. Account data may be hosted on the provider's servers located outside the user's country of residence; by creating the account, the user accepts such international transfer on the terms described here.
9. Changes to this policy. The Controller may update this policy, publishing the version in force, with its update date, at this same address. Any new processing of personal data (for example, the addition of analytics) will be reflected in the policy prior to its activation, indicating its purpose, legal basis, retention periods and mechanisms for exercising rights.
