1. Objeto e identificación. Los presentes términos y condiciones (en adelante, los «Términos») regulan el acceso y el uso del juego web «History's Gambit — Chess Campaigns of Legend» (en adelante, el «Servicio» o el «Juego»), operado por la titularidad del proyecto History's Gambit (en adelante, el «Operador»), con base de operaciones en la República de Colombia y canal de contacto en la dirección de correo electrónico historysgambit@gmail.com. El acceso, la navegación y el uso del Servicio atribuyen la condición de usuario (en adelante, el «Usuario») e implican la aceptación plena y sin reservas de la totalidad de los presentes Términos en la versión publicada en el momento del acceso, por lo que se recomienda al Usuario su lectura íntegra y periódica. Si el Usuario no estuviere de acuerdo con cualquiera de las estipulaciones aquí contenidas, deberá abstenerse de utilizar el Servicio.
2. Licencia de uso. El Operador concede al Usuario una licencia de uso personal, gratuita, no exclusiva, intransferible, no sublicenciable y revocable, para acceder al Juego mediante un navegador web con fines exclusivos de entretenimiento y formación personal. Queda expresamente prohibida, sin autorización previa, expresa y escrita del Operador, toda forma de reproducción, distribución, comunicación pública, transformación, comercialización, reventa, sublicencia, descompilación, ingeniería inversa, extracción sistemática de contenidos o cualquier otra explotación del Servicio o de cualquiera de sus elementos distinta del uso personal aquí licenciado, en la medida en que tales restricciones resulten compatibles con las excepciones legales imperativas que resulten de aplicación.
3. Propiedad intelectual e industrial. El código fuente del Juego, los textos narrativos, los mapas, las ilustraciones, el motor de ajedrez, el conjunto de problemas y composiciones, la disposición de los contenidos y los signos distintivos del Servicio constituyen obra original del proyecto y se encuentran protegidos por la normativa nacional e internacional sobre derecho de autor y propiedad intelectual, correspondiendo su titularidad o legítima licencia al Operador. Los gráficos de las piezas de ajedrez derivan del conjunto «Cburnett», de Colin M. L. Burnett, utilizado al amparo de su licencia BSD; las tipografías Cinzel y EB Garamond se utilizan al amparo de la SIL Open Font License 1.1; la información completa de atribuciones puede consultarse en la página de créditos. Las citas históricas reproducidas pertenecen al dominio público. Nada en los presentes Términos podrá interpretarse como cesión o licencia de derechos de propiedad intelectual a favor del Usuario distinta de la licencia de uso descrita en la cláusula segunda.
4. Juego gratuito, contenido premium opcional (Libro II) y reembolsos. El acceso al Servicio y a las crónicas del Libro I es gratuito, sin coste económico alguno; no obstante, el acceso a las campañas distintas de la primera crónica requiere el registro gratuito de una cuenta, conforme a la cláusula 5. De forma opcional, el Usuario puede adquirir mediante un pago único el contenido premium del «Libro II — La Era de la Pólvora». Dicha venta se realiza a través de Lemon Squeezy (Lemon Squeezy, Inc.), que actúa como Merchant of Record y vendedor de dicho contenido: es Lemon Squeezy quien procesa el pago, emite la factura correspondiente y se encarga de la recaudación y remisión de los impuestos indirectos (IVA y equivalentes) que apliquen en cada jurisdicción, conforme a sus propios términos y política de privacidad. Tras la compra, el Usuario recibe una clave de licencia que activa el contenido en el Juego. En materia de reembolsos se aplicará, como mínimo, el derecho de retracto previsto en el Estatuto del Consumidor colombiano (Ley 1480 de 2011) y, respecto de usuarios residentes en la Unión Europea, el derecho de desistimiento de catorce (14) días naturales previsto en la Directiva 2011/83/UE, sin perjuicio de las excepciones legalmente aplicables al suministro de contenido digital cuya ejecución haya comenzado con el consentimiento del Usuario; las solicitudes se tramitan a través de Lemon Squeezy o del correo de contacto del Operador.
5. Cuentas de usuario y uso aceptable. El uso de una parte del Servicio (la primera crónica, el reto diario y el tutorial de iniciación) no requiere registro; para acceder al resto de las campañas y para continuar en el modo «La Encrucijada» tras una derrota, el Usuario debe crear una cuenta gratuita mediante una dirección de correo electrónico y una contraseña, que asimismo conserva y sincroniza su progreso entre dispositivos. El Usuario es responsable de la veracidad de los datos facilitados, de la custodia y confidencialidad de sus credenciales y de toda actividad realizada a través de su cuenta, comprometiéndose a notificar al Operador cualquier uso no autorizado. El Usuario declara tener capacidad legal suficiente para aceptar los presentes Términos. El tratamiento de los datos de la cuenta se rige por la política de privacidad; el Usuario puede solicitar la supresión de su cuenta y de los datos asociados en cualquier momento a través del correo de contacto. Asimismo, el Usuario se obliga a utilizar el Servicio de conformidad con la ley, la moral, el orden público y los presentes Términos, y a abstenerse de: (i) realizar cualquier actuación dirigida a vulnerar, eludir, sobrecargar, dañar o interferir el funcionamiento del Servicio o de la infraestructura que lo aloja; (ii) introducir o difundir programas maliciosos o cualquier otro elemento susceptible de causar daños; (iii) utilizar el Servicio con fines ilícitos o no autorizados; (iv) suplantar la identidad del Operador o de terceros ni acceder o intentar acceder a cuentas ajenas; y (v) crear cuentas de forma fraudulenta o masiva. El Operador se reserva el derecho de denegar, suspender o restringir el acceso al Servicio o a una cuenta, sin previo aviso, a cualquier Usuario que incumpla los presentes Términos.
6. Disponibilidad, exclusión de garantías y limitación de responsabilidad. El Servicio se presta «tal cual» y «según disponibilidad», sin garantía expresa o implícita de ninguna clase respecto de su continuidad, disponibilidad, ausencia de errores, idoneidad para un propósito particular o satisfacción de expectativas del Usuario, en la máxima medida permitida por la legislación aplicable. El Operador podrá modificar, actualizar, suspender o retirar el Servicio, total o parcialmente, en cualquier momento y sin necesidad de preaviso. En la máxima medida permitida por la ley, el Operador no responderá de los daños y perjuicios indirectos, lucro cesante, pérdida de datos o cualquier otro daño derivado del uso o de la imposibilidad de uso del Servicio. El contenido narrativo del Juego constituye una obra de entretenimiento de inspiración histórica que puede contener simplificaciones, dramatizaciones y licencias literarias, y no constituye material académico, historiográfico ni de referencia. Ninguna de las exclusiones y limitaciones anteriores afectará a aquellos derechos que la normativa imperativa de protección al consumidor reconozca al Usuario y que no puedan ser objeto de exclusión o limitación contractual.
7. Modificación de los Términos. El Operador se reserva la facultad de modificar en cualquier momento los presentes Términos, mediante la publicación de la versión actualizada en esta misma dirección con indicación de su fecha de actualización. El uso del Servicio con posterioridad a la publicación de una modificación implicará la aceptación de los Términos vigentes en cada momento.
8. Nulidad parcial. La declaración de nulidad, invalidez o ineficacia de cualquiera de las estipulaciones de los presentes Términos no afectará a la validez y eficacia de las restantes, que se mantendrán vigentes, comprometiéndose las partes a sustituir la estipulación afectada por otra válida de efecto equivalente.
9. Ley aplicable y jurisdicción. Los presentes Términos se rigen por las leyes de la República de Colombia. Toda controversia derivada del acceso o uso del Servicio se someterá a los jueces y tribunales competentes de la República de Colombia, sin perjuicio de aquellas normas imperativas de protección al consumidor que reconozcan al Usuario la facultad de acudir a los tribunales de su lugar de residencia o que determinen otro fuero irrenunciable.

1. Purpose and identification. These terms and conditions (the «Terms») govern access to and use of the web game «History's Gambit — Chess Campaigns of Legend» (the «Service» or the «Game»), operated by the ownership of the History's Gambit project (the «Operator»), based in the Republic of Colombia, with a contact channel at the email address historysgambit@gmail.com. Access to, browsing of and use of the Service confer the status of user (the «User») and imply full and unreserved acceptance of all of these Terms in the version published at the time of access; the User is therefore advised to read them in full and periodically. If the User does not agree with any of the provisions contained herein, they must refrain from using the Service.
2. Licence of use. The Operator grants the User a personal, free, non-exclusive, non-transferable, non-sublicensable and revocable licence to access the Game through a web browser for the exclusive purposes of entertainment and personal education. Without the Operator's prior, express and written authorisation, any form of reproduction, distribution, public communication, transformation, commercialisation, resale, sublicensing, decompilation, reverse engineering, systematic extraction of contents or any other exploitation of the Service or any of its elements other than the personal use licensed herein is expressly prohibited, to the extent that such restrictions are compatible with the mandatory legal exceptions that may apply.
3. Intellectual and industrial property. The Game's source code, the narrative texts, the maps, the illustrations, the chess engine, the set of puzzles and compositions, the arrangement of the contents and the distinctive signs of the Service constitute original work of the project and are protected by national and international copyright and intellectual property law, their ownership or legitimate licence belonging to the Operator. The chess piece graphics derive from the «Cburnett» set by Colin M. L. Burnett, used under its BSD licence; the Cinzel and EB Garamond typefaces are used under the SIL Open Font License 1.1; full attribution information can be found on the credits page. The historical quotations reproduced are in the public domain. Nothing in these Terms may be interpreted as an assignment or licence of intellectual property rights to the User other than the licence of use described in clause two.
4. Free game, optional premium content (Book II) and refunds. Access to the Service and to the chronicles of Book I is free, at no economic cost; however, access to campaigns other than the first chronicle requires the free registration of an account, in accordance with clause 5. Optionally, the User may purchase, through a single payment, the premium content of «Book II — The Age of Gunpowder». That sale is made through Lemon Squeezy (Lemon Squeezy, Inc.), which acts as Merchant of Record and seller of that content: it is Lemon Squeezy that processes the payment, issues the corresponding invoice and handles the collection and remittance of the indirect taxes (VAT and equivalents) applicable in each jurisdiction, in accordance with its own terms and privacy policy. After purchase, the User receives a licence key that activates the content in the Game. As regards refunds, at a minimum the right of withdrawal provided for in the Colombian Consumer Statute (Law 1480 of 2011) and, for users resident in the European Union, the fourteen (14) calendar day right of withdrawal provided for in Directive 2011/83/EU will apply, without prejudice to the exceptions legally applicable to the supply of digital content whose performance has begun with the User's consent; requests are handled through Lemon Squeezy or the Operator's contact email.
5. User accounts and acceptable use. Use of part of the Service (the first chronicle, the daily challenge and the introductory tutorial) does not require registration; to access the rest of the campaigns and to continue in «The Crossroads» mode after a defeat, the User must create a free account using an email address and a password, which also preserves and synchronises their progress across devices. The User is responsible for the truthfulness of the data provided, for the custody and confidentiality of their credentials and for all activity carried out through their account, undertaking to notify the Operator of any unauthorised use. The User declares that they have sufficient legal capacity to accept these Terms. The processing of account data is governed by the privacy policy; the User may request the deletion of their account and associated data at any time through the contact email. Likewise, the User undertakes to use the Service in accordance with the law, morality, public order and these Terms, and to refrain from: (i) carrying out any action aimed at breaching, circumventing, overloading, damaging or interfering with the operation of the Service or the infrastructure that hosts it; (ii) introducing or spreading malicious software or any other element capable of causing damage; (iii) using the Service for unlawful or unauthorised purposes; (iv) impersonating the Operator or third parties, or accessing or attempting to access others' accounts; and (v) creating accounts fraudulently or en masse. The Operator reserves the right to deny, suspend or restrict access to the Service or to an account, without prior notice, to any User who breaches these Terms.
6. Availability, disclaimer of warranties and limitation of liability. The Service is provided «as is» and «as available», without express or implied warranty of any kind as to its continuity, availability, freedom from errors, fitness for a particular purpose or satisfaction of the User's expectations, to the maximum extent permitted by applicable law. The Operator may modify, update, suspend or withdraw the Service, in whole or in part, at any time and without prior notice. To the maximum extent permitted by law, the Operator shall not be liable for indirect damages, loss of profit, loss of data or any other damage arising from the use of or inability to use the Service. The narrative content of the Game is a work of entertainment of historical inspiration that may contain simplifications, dramatisations and literary licence, and does not constitute academic, historiographical or reference material. None of the foregoing exclusions and limitations shall affect those rights that mandatory consumer protection law grants to the User and that cannot be excluded or limited by contract.
7. Modification of the Terms. The Operator reserves the right to modify these Terms at any time, by publishing the updated version at this same address with its update date. Use of the Service after the publication of a modification implies acceptance of the Terms in force at any given time.
8. Partial invalidity. The declaration of nullity, invalidity or ineffectiveness of any of the provisions of these Terms shall not affect the validity and effectiveness of the remaining ones, which shall remain in force, the parties undertaking to replace the affected provision with a valid one of equivalent effect.
9. Governing law and jurisdiction. These Terms are governed by the laws of the Republic of Colombia. Any dispute arising from access to or use of the Service shall be submitted to the competent courts of the Republic of Colombia, without prejudice to those mandatory consumer protection rules that grant the User the right to bring proceedings before the courts of their place of residence or that determine another non-waivable jurisdiction.
